A Guardianship Proceeding is the process whereby the court appoints someone to manage the financial and/or personal affairs of an incapacitated adult or a minor if that individual is no longer competent enough to use lifetime planning techniques such as a Power of Attorney. Incapacity must be proven by two physicians who are of the opinion that the alleged incapacitated person is unfit and unable to govern him or herself and to manage his or her affairs.
